AGREEMENT OF RELEASE AND WAIVER OF LIABILITY
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, PHOTO AND VIDEO
DISCLAIMER CLAUSE
Daniel Levi, Florida Center For Capoeira LLC., their officers, directors, employees, volunteers, contractors, members, and representatives are not responsible for any injury, illness, loss, or damage of any kind sustained by any person while participating in the Capoeira Classes, Capoeira “Rodas” (Circle), Fitness Classes, Personal training session, Dance Classes, Acrobatic Classes, Open Mat, Programs, Workshops, Seminar, Retreats, Ceremonies, Annual Events, Capoeira Performances and/or Demonstrations.
I hereby agree to the following:
That I am participating in the Capoeira Classes, Capoeira “Rodas” (Circle), Fitness Classes, Personal training session/s, Dance Classes, Acrobatic Classes, Open Mat, Programs, Workshops, Seminars, Retreats, Ceremonies, Annual Events, Capoeira Performances and/or Demonstrations. during which I will receive information and instruction about the class activity that I attend. I recognize that participation in the activities listed above requires physical exertion, which may be strenuous and may cause physical injury and I am fully aware of the risks and hazards involved.
I understand that it is my sole responsibility to consult with a physician prior to and regarding my participation in the Capoeira Classes, Capoeira “Rodas” (Circle), Fitness Classes, Personal training session/s, Dance Classes, Acrobatic Classes, Open Mat, Classes, Programs, Workshops, Seminar, Retreats, Ceremonies, Annual Events, Capoeira Performances and/or Demonstration. I represent and state that I am in good health, physically fit, and have no medical condition that would prevent my full participation in all the activities listed above.
In consideration of being permitted to participate in the Capoeira Classes, Capoeira “Rodas” (Circle), Fitness Classes, Personal training session/s, Dance Classes, Acrobatic Classes, Open Mat, Classes, Programs, Workshops, Seminar, Retreats, Ceremonies, Annual Events, Capoeira Performances and/or Demonstration, I sign this agreement and agree to assume full responsibility for any risks, illness, injuries and/or damages, known or unknown, which I might incur as a result of participating in any of the programs listed above.
In the further understanding of being permitted to participate in the Capoeira Classes, Capoeira “Rodas” (Circle), Fitness Classes, Personal training session/s, Dance Classes, Acrobatic Classes, Open Mat, Boxing, Classes, Programs, Workshops, Seminar, Retreats, Ceremonies, Annual Events, Capoeira Performances and/or Demonstration, I knowingly, voluntarily and expressly waive any claim I may have against Daniel Levi, Florida Center For Capoeira LLC., the instructor, participants or the owner or leaseholder of the building for injuries, illness or damages that I may sustain as a result of participating in Capoeira Classes, Capoeira “Rodas” (Circle), Fitness Classes, Personal training session/s, Dance Classes, Acrobatic Classes, Open Mat, Classes, Programs, Workshops, Seminar, Retreats, Ceremonies, Annual Events, Capoeira Performances and/or Demonstration.
I, my heirs, or legal representative or such forever release, waive, discharge and covenant not to sue or litigate in any way, Daniel Levi, Florida Center For Capoeira LLC., any instructor or participants, the leaseholder or owner of the building for any injury, illness or death caused by their negligence or other acts.
Media Use Consent: Florida Center for Capoeira and Daniel Levi reserves the right to use and display any and all media (photo, film, etc.) obtained from its members for use in the advertisement of their facilities, classes, and/or events.
Communications: Florida Center For Capoeira LLC and/or Daniel Levi may use your Personal Information to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email and/or text we send.
Compliance With Laws: Florida Center For Capoeira LLC and/or Daniel Levi will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service.
Release and waiver - addition.
I hereby release, waive and forever discharge any and all liability, claims, and demands for whatever kind or nature against Florida Center For Capoeira LLC and its affiliated partners, including in each case, without limitation, their director, officers, employees, volunteers, contractors, members, instructors and representatives (the released parties), either in law or un equity, to the fullest extent permissible by law, including, but not limited to damages or losses caused by the negligence, fault, or conduct of any kind on the part of the released partied, including but not limited to death, bodily injury, illness, economic loss or out of pocket expenses, or loss or damage to property, which I, my heirs, assignees, next of kin and/or legally appointed or designated representative, may have or which may hereinafter accuse on my behalf, which arises or may hereafter arise from my participation with the activity.Inappropriate behavior towards teachers, substitute teachers, instructors, guests, and/or fellow participants will not be tolerated in, Capoeira Classes, Rodas (Circles), Fitness Classes, Dance Classes, Brazilian jiu-jitsu, Acrobatic Classes, Programs, Workshops, Seminars, Retreats, Ceremonies, Annual Events, Capoeira Performances and/or Demonstrations. Daniel Levi, Florida Center For Capoeira LLC., its instructors, and/or teachers reserve the right to suspend, revoke membership, and/or expel participants from the group, due to inappropriate behavior.
ACKNOWLEDGMENT
I acknowledge that I have read this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, executors, administrators, and representatives
